Terms of Service

1. Acceptance of Terms

By accessing or using the FlatForSale platform at flatforsale.co.in(the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and FlatForSale, a registered MahaRERA Channel Partner operating in Maharashtra, India.

2. Description of Services

FlatForSale is a real estate channel partner and intermediary. We provide:

• Property listing discovery and information services
• Connection services between prospective buyers and real estate developers
• Advisory and consultation services for property transactions
• Site visit facilitation and coordination

We are a channel partner and facilitator, not a developer or property owner. All listed properties are owned and developed by third-party real estate developers. FlatForSale does not own, manage, or control any of the listed properties.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts under applicable Indian law to use this Platform. By using the Platform, you represent and warrant that you meet these requirements.

4. Property Information Accuracy

All property information, including pricing, specifications, floor plans, amenities, RERA registration details, and possession timelines, is provided in good faith based on information received from developers and builders. However:

• Property details are subject to change without notice
• Pricing and availability are indicative and must be confirmed directly with the developer
• Images and renders shown may be artistic impressions and may not represent the final product
• FlatForSale does not guarantee the accuracy, completeness, or timeliness of any property information

Prospective buyers are strongly advised to independently verify all project information through the official MahaRERA portal at maharerait.maharashtra.gov.in before making any purchase or booking decision.

5. MahaRERA Compliance

FlatForSale is registered as a Real Estate Agent under the Maharashtra Real Estate (Regulation and Development) Act, 2016 (Maharashtra RERA).

All project listings displayed on this Platform include MahaRERA project registration numbers where available. Buyers are required to verify these independently before any financial commitment.

6. Enquiry Submissions

When you submit an enquiry through our Platform, you:

• Confirm that all information you provide is accurate and truthful
• Consent to being contacted by FlatForSale representatives via phone, WhatsApp, email, or SMS regarding your enquiry
• Acknowledge that submitting an enquiry does not constitute a reservation, booking, or purchase
• Agree that FlatForSale may share your contact information with relevant developers for the purpose of responding to your enquiry

7. Prohibited Conduct

You agree not to:

• Submit false, misleading, or fraudulent enquiries
• Use automated tools or bots to submit enquiries or scrape content
• Attempt to gain unauthorised access to any part of the Platform
• Transmit spam, malware, or any harmful content
• Misrepresent your identity or affiliation
• Use the Platform for any unlawful purpose

8. Limitation of Liability

To the fullest extent permitted by applicable law, FlatForSale shall not be liable for:

• Any loss arising from reliance on property information displayed on the Platform
• Delays, changes, or cancellations of property projects by developers
• Any transaction disputes between buyers and developers
• Indirect, incidental, consequential, or punitive damages of any kind
• Losses arising from technical failures, downtime, or data breaches beyond our reasonable control

FlatForSale's total aggregate liability shall not exceed the amount of any consultation fee paid to us, if any, in the 30 days preceding the claim.

9. Intellectual Property

All content on this Platform, including text, graphics, logos, images, and software, is the property of FlatForSale or its content suppliers and is protected under applicable intellectual property laws. Unauthorised reproduction or distribution is prohibited.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Maharashtra, India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
